Bardot may at its absolute discretion amend the terms and conditions from time to time by posting the amended terms and conditions on the website and as such, will be effective as at that date. Should you not agree with such changes, you must terminate your membership of Bardot by email notification to hello@bardot.com.

The terms and conditions outlined here may be amended from time to time without notice to you and will apply to orders placed effective as at the date of amendment. Every effort is made to keep the website up and running smoothly. However, Barol Pty Ltd takes no responsibility for and will not be liable for the website being temporarily unavailable due to technical issues beyond control.

BARDOT MEMBERSHIP

To become a registered customer, you must be able to enter into a legally binding contract under relevant laws and you must not be a suspended Bardot member. Your account may not be transferred or sold to another party.

You warrant that all information and data provided by you during this registration process is accurate, complete and up to date. You must promptly inform Bardot if there is a change to this information or data.

You must take responsibility for the safekeeping of your username and password. Upon completion of a transaction/ website visit to Bardot, it is advisable to log off to ensure your personal information submitted to Bardot is not used by the next person on the computer. You are liable for any activity if an unauthorised person uses your username and password. You release and indemnify Bardot in relation to any liability arising out of the unauthorised use of your username or password. If you suspect or know that someone has stolen or obtained your username and password, you must contact Bardot in writing to cancel and/or change it.

PAYMENT

We accept payments by credit card from Visa, MasterCard, American Express, PayPal and Afterpay.

Depending on your circumstances, you may have to pay additional exchange rate costs and fees as charged by your credit card issuer. We will not be liable for any costs associated with exchange rates or bank fees.

Purchases made using Afterpay are subject to the Afterpay Terms and Conditions.

Your credit card purchase may take a few minutes to process to allow us time to confirm your billing information with your financial institution.

SECURITY

Any personal information that you submit will be protected by our secure SSL payment gateway server, which uses 256-bit security technology to protect your online order information. This technology encrypts all information including your credit card and all personal information passed from you through our website.

For security purposes, Bardot is entitled to request credit card verification at their discretion. Bardot reserves the right not to proceed with the order sale and refund the payment made.

To reduce the risk of online credit card fraud, Bardot may request additional information to process an online order. A small charge may be charged to your account for verification purposes, however the full amount will be refunded as soon as the order has been successfully verified. Customers will be notified via email if further information is needed.

Bardot reserves the right to cancel the order and process a refund if necessary.

FRAUD

By registering online with Bardot, you agree that all of the details you supply to Bardot are correct and accurate. As the accuracy of all personal details provided by users cannot be confirmed, Bardot takes no responsibility for the inaccuracy of details and/or the false identity of any user. Bardot may suspend or terminate your membership at any time in its sole discretion, if Bardot suspects, proves and/or determines in the circumstances that you are or have been engaged in any fraudulent activity in relation to the website. Bardot reserves its rights to take any applicable and available legal action against you for fraudulent, misleading and deceptive conduct.

GST & TAXES

The Australian GST tax rate applies to all orders delivered within Australia.

International orders are exempt from Australian GST (10%); however they may incur taxes and duties applied by customs in the country where the order is delivered.

Any duties and taxes incurred in the country of destination are the responsibility of the customer. If you require further information about your country's taxes and duties you will need to contact your local customs office directly.

To comply with Australian export regulations, we are required to declare the exact value of all items ordered and to mark them as dutiable merchandise.

We are also prohibited by law from marking the order as a gift, even if order is placed with the intention of sending to a gift recipient.

TERMS OF SALE

All purchases via the website are transacted in Australian dollars.

Prices online are exclusive of delivery charges. Prices are subject to change without notice. Pricing for your order is as agreed to at the time the order is placed and will be reflected in your order confirmation email. Reduction in price and promotional discounts cannot be applied to prior purchases, and as stated no amendments can be made to your order once it has been submitted

Goods are subject to availability. An order for goods is accepted at the time of entering of your credit card details. Payment will be validated and accepted real time. If a good/ goods you have ordered is/are out of stock, you shall be notified as soon as possible, and your payment will be refunded to the payment method used to complete the transaction.

Bardot reserves the right to amend and update promotional activity on the website without notice. Please note, no changes or amendments can be made to an order once it has been submitted. This includes any request to cancel the order.

Any discounts triggered by the entry of a promotional code will not be applied until payment is validated and will be detailed on the invoice. Bardot reserves the right to refuse an order. Non-acceptance of an order may include but is not limited to:

  • The product ordered is unavailable from stock
  • The inability to obtain authorisation of payment
  • The identification of an error within the product information, including price or promotion

If there are any problems with your order, Bardot will contact you, utilising the contact details entered at checkout at the time of placing your order.

From time to time, Bardot and related company retail stores may run special local promotions (which may not be available on the website) and there may be special offer discounts on the website that are not available in the Bardot and the Bardot related retail stores. Some website promotions may not be available to customers in particular jurisdictions.

Bardot reserves the right to refuse orders where product information has been published in error and this includes but is not limited to incorrect or misstated prices and promotions.

RESALE OF BARDOT PRODUCTS

You may only place orders via this website for private and domestic purposes. A customer is prohibited from purchasing goods from Bardot for the purpose of resale and on sale to other persons whether as a business or non-business and goods are only for personal use including but not limited to gifting and/or on behalf of another for their personal use. A breach of this will result in cancellation and/or refusal of registration/ order for goods.

TERMS OF USE

eGift Cards can be purchased and redeemed on bardot.com and are valid for three (3) years from the purchase date. After the egift card has expired, it is no longer valid and all transactions will be declined. Unused value will not be refunded and will become property of Bardot.

Amounts shown on Bardot eGift Cards are shown in Australian Dollars (AUD). Bardot eGift Cards cannot be purchased or redeemed in any partnered wholesaler, such as Myer, David Jones, ICONIC and Independent Boutiques.

eGift Cards cannot be purchased with a discount, including the following:

  • Membership discounts including Member 10%, sign up vouchers and birthday vouchers
  • Store wide promotions such as ‘20% off full price items’
  • eGift Cards cannot be purchased with another egift card, credit note or promotional voucher.

eGift Cards are not reloadable and cannot be returned or exchanged for cash.

To redeem your eGift Card online enter your eGift Card number and APPLY during checkout. The balance of any transaction will remain on the eGift Card. You can check the balance of an eGift Card by visiting the Gift Cards webpage on our website. No cash change can be given.

Return vouchers will be issued when a sale product/item cannot be exchanged due to no stock availability and are valid for 6 months from issue date and can be redeemed on bardot.com.

Return vouchers can be used in full or as part payment and any remaining balance will stay until the expiry date given at issue. Bardot is unable to extend credit notes beyond the expiry date.

Bardot cannot be held responsible for lost or stolen return vouchers. Please keep your PIN somewhere safe as lost or stolen return vouchers cannot be re-issued. 
Return vouchers cannot be exchanged for cash.
